Ballot Question 2E on Rezoning of 4000-4060 Upham
At the August 26, 2019, regular meeting of the Wheat Ridge City Council, the Council acted on a referendum petition that was submitted by Wheat Ridge residents whether to rezone the property at 4000-4060 Upham. City Council referred the following ballot question for a vote of the people in the election on November 5, 2019.

Shall Ordinance 1667, an ordinance rezoning real property at 4000-4060 Upham Street, City of Wheat Ridge, from Residential-Three (R-3) to Planned Residential Development (PRD) with an outline development plan (ODP) allowing for 38 townhome units in nine buildings, go into effect?

On August 29, 2019, a complaint was filed in Jefferson County District Court (Case No. 2019 CV 31333), challenging the petition and its inclusion on the 2019 ballot.

The decision on the complaint will be determined by a District Court judge, and until that time the question will remain on the ballot for Wheat Ridge voters to decide.
